Complying Development in Marsden Park: What Fits Under the Housing Code

September 24, 2026 7 min read By admin

Marsden Park is one of the most CDC-friendly release corridors in Sydney. The blocks are flat, rectangular and mostly clear of established trees. The zoning is R2 or R3 residential across most of the release estates. And the design controls in the Blacktown DCP align well with the state Housing Code’s fixed rules. If you can build a straightforward four-bedroom double storey inside the code’s setbacks and heights, the CDC path issues in 8 to 12 weeks — versus 16 to 24 for a DA.

Here is what the CDC path actually looks like in Marsden Park in 2026: what the Housing Code allows, where the flood and bushfire mapping bites, and how to know before you draw a plan whether your block qualifies.

The Housing Code test in one page

Under the State Environmental Planning Policy (Exempt and Complying Development Codes) 2008, a new one or two-storey dwelling can be approved as a Complying Development Certificate (CDC) if:

  • The land is zoned residential (R2 or R3 in Marsden Park terms) and is at least 200 m² with 6 m frontage at the building line.
  • The land is NOT flood mapped above the CDC threshold — in Blacktown this generally means outside the 1% AEP flood extent around Bells Creek and its tributaries.
  • The land is NOT bushfire prone at Category 1 or 2 (Category 3 is workable with additional construction upgrades).
  • The land is NOT heritage listed or in a conservation area.
  • The land is NOT above 25 ANEF (irrelevant for Marsden Park — well outside the Sydney airport curves).
  • The design meets every fixed rule: setbacks (6 m front, 900 mm sides for a standard lot), height (8.5 m for two-storey), site coverage (50% max), landscape (25% min), private open space, articulation.

Most Marsden Park release blocks — Elara, Waterlily, Tallawong Rise, Marsden Park Industrial-adjacent estates — clear these tests without a struggle. Where the Housing Code fails, it usually fails on one specific trigger.

Where the CDC path fails in Marsden Park

Bells Creek flood mapping

The 1% AEP flood extent around Bells Creek runs through parts of Marsden Park and knocks out CDC on blocks flagged flood-affected on the section 10.7 certificate. The affected zones are the eastern edge of the Elara estate and pockets adjacent to the creek line. On those blocks, a DA is required, floor levels must sit at the flood planning level (roughly 1% AEP + 500 mm freeboard), and often flood-compatible ground floor construction is needed. Add $15-$40k to site costs and 4-8 weeks to approval.

Biodiversity certification

Some Marsden Park release areas sit within Biodiversity Certification zones under the NSW BC Act 2016. The certification handles the biodiversity offset at a whole-of-precinct level, which means individual blocks don’t need biodiversity assessment reports — but if a block is outside the certified area, or has residual vegetation, an assessment may still be required. This is more common on the northern fringe of the release toward Riverstone.

Corner blocks and irregular geometry

Corner lots have two primary frontages and setback rules apply to both. On a standard rectangular Marsden Park corner block a 5-bedroom double storey often fails the secondary frontage setback under the Housing Code — but works fine under a DA with a merit-based variation. About 15% of Marsden Park CDCs we look at get flipped to DA for this reason.

Overshadowing an adjoining private open space

The Housing Code caps overshadowing of a neighbouring principal private open space. On south-facing Marsden Park blocks where the neighbour to the north has their yard on the shared boundary, a two-storey CDC design can breach the overshadowing rule. A DA with modelled shadow diagrams can approve the same house.

What the CDC path saves you

Concrete numbers on a Marsden Park build:

  • Approval time: CDC 8-12 weeks; DA 16-22 weeks. Saves 6-14 weeks of contract time.
  • Fees: CDC $2,500-$4,500 to the certifier; DA $3,500-$6,000 to Blacktown council plus certifier fees at CC. CDC saves $2-$5k on average.
  • Drawing set: CDC drawings are lighter — no Statement of Environmental Effects, no arborist report unless the site has protected trees, no stormwater concept beyond the standard code detail. Save $2-$4k in drafting fees.
  • Total: $6-$14k saved and 6-14 weeks earlier to slab pour.

How we test CDC eligibility before drawing anything

Every Marsden Park file we take on runs through a five-step eligibility check:

  1. Section 10.7 planning certificate — pull directly from Blacktown Council. Confirms zoning, flood affectation, bushfire, heritage.
  2. Blacktown flood map overlay — cross-check the certificate against the current map (updated periodically).
  3. Housing Code numerical test — do a first-pass site plan showing the intended footprint, check setbacks, height, site coverage, landscape area, private open space.
  4. Neighbour overshadowing check — a preliminary shadow diagram at 21 June from 9 am to 3 pm.
  5. Design review — does the design need any element the code cannot authorise? Facade features, cantilever, particular window placement.

If all five clear, we lodge CDC. If any fails, we plan a DA from day one and design accordingly. See our DA versus CDC in Blacktown post for the wider decision framework.

Marsden Park build cost 2026, CDC vs DA

Same Modern Essential four-bedroom double storey on a flat 450 m² Marsden Park release block:

Line item CDC path DA path
Turnkey build (fixed) $489,000 $489,000
Approval fees $3,800 $5,900
Drawing set $5,500 $9,500
Approval time 10 weeks 18 weeks
Total to slab-ready ~14 weeks after signing ~22 weeks after signing

These are indicative; individual sites vary. See the 2026 cost breakdown for the full pricing picture.

Frequently asked questions

Can I get a CDC for any block in Marsden Park?
Most Marsden Park release blocks qualify. The ones that don’t are flood-affected near Bells Creek, corner lots where the design breaches a secondary frontage setback, and some sites near the northern fringe with residual biodiversity constraints. We test all five criteria at first assessment before any drawing work.

How much faster is a CDC than a DA in Blacktown council area in 2026?
6 to 14 weeks faster on average. CDCs issue in 8 to 12 weeks with a private certifier; Blacktown DAs run 16 to 22 weeks for a standard new-dwelling assessment. The gap has narrowed slightly since 2024 as council has streamlined some processes, but CDC remains faster.

What is the biggest reason a Marsden Park CDC gets refused?
Overshadowing failure on the neighbouring block’s principal private open space is the most common. Second is failure of the secondary frontage setback on a corner lot. Third is the site being flood-affected above the CDC threshold — but that’s usually caught at eligibility check before lodgement.

Can I lodge a CDC directly with Blacktown council?
No — CDCs are issued by private certifiers, not council. Blacktown gets a notification but does not assess the CDC. You choose the certifier; we usually appoint one at contract signing and coordinate through them.

Does BASIX apply to a CDC in Marsden Park?
Yes. BASIX applies to any new dwelling in NSW regardless of approval pathway. From 2026 the target is 7-star NatHERS or better plus a thermal comfort compliance check at Construction Certificate and Occupation Certificate. See our upcoming BASIX post for the technical detail.

Can I convert a rejected DA into a CDC?
Rarely. A DA is refused for reasons that the CDC cannot fix (usually a design that breaches multiple code rules). More common is the reverse: a lapsed CDC (certifier can’t issue because a design fails) is redirected to a DA with the necessary variations argued on merit.
